--- title: "Terms of Service" description: "Terms that govern access to and use of Liutong" --- Last updated: June 15, 2026 These Terms of Service ("Terms") govern your access to and use of Liutong, an OpenAI-compatible API service provided by LLBY LLC ("LLBY," "we," "us," or "our"). By using Liutong, you agree to these Terms. If you use Liutong on behalf of an organization, you represent that you have authority to bind that organization to these Terms. In that case, "you" includes both you and the organization. ## Service overview Liutong provides API access to language, reasoning, media, and embeddings models through an OpenAI-compatible interface. The service authenticates requests using Liutong API keys and may route requests through upstream model infrastructure and providers. Access is currently provided through organizational enrollment, administrator provisioning, or supported marketplace deployment flows. Open public self-service signups may not be available. ## Accounts and API keys You are responsible for all activity under API keys issued to you or your organization. You must: - Keep API keys confidential and secure. - Use separate keys for separate teams, applications, or environments where practical. - Promptly rotate or revoke keys that may have been compromised. - Notify your administrator or LLBY if you suspect unauthorized use. We may suspend, revoke, rotate, or refuse API keys to protect the service, enforce these Terms, comply with law, or respond to security concerns. ## Acceptable use You may use Liutong only in compliance with applicable laws, these Terms, your organization's policies, and any applicable upstream provider policies. You must not use Liutong to: - Violate laws, regulations, sanctions, export controls, or third-party rights. - Generate, request, or distribute illegal, abusive, exploitative, or harmful content. - Build or operate systems intended to deceive, defraud, harass, impersonate, or unlawfully surveil people. - Develop malware, credential theft, vulnerability exploitation, or other harmful cyber capabilities. - Bypass rate limits, authentication, access controls, safety systems, or usage restrictions. - Interfere with, overload, scan, or disrupt Liutong or related infrastructure. - Resell, sublicense, or provide shared access to Liutong unless we have agreed in writing. - Submit data you are not permitted to process or transmit through the service. We may investigate suspected misuse and may limit, suspend, or terminate access when we believe use violates these Terms or creates risk to LLBY, users, providers, or third parties. ## Your content and outputs You are responsible for the prompts, inputs, files, data, and other content you submit to Liutong ("Input") and for how you use model outputs ("Output"). You represent that you have all rights and permissions needed to submit Input and use Output. Liutong does not guarantee that Output is accurate, complete, unique, safe, lawful, or suitable for any particular purpose. You are responsible for evaluating Output before relying on it, especially in legal, medical, financial, employment, security, safety-critical, or other high-impact contexts. Do not submit sensitive personal data, protected health information, payment card data, regulated secrets, or confidential third-party information unless your organization has approved that use and appropriate agreements and safeguards are in place. ## Usage, billing, and limits Liutong records usage metadata, including token counts, endpoints, models, status codes, latency, team names, and timestamps, for operations, troubleshooting, security, and cost attribution. Your use may be subject to rate limits, quotas, model availability, marketplace plan limits, billing arrangements, or organizational policies. We may modify limits or restrict access to protect reliability, manage costs, or comply with provider constraints. Fees, if any, are governed by the applicable order, marketplace plan, invoice, statement of work, or written agreement between you or your organization and LLBY or an authorized marketplace provider. ## Third-party services Liutong may depend on third-party infrastructure, cloud platforms, model providers, identity providers, and marketplaces, including Azure services. These third-party services may process Input, Output, metadata, authentication data, and provisioning data as needed to provide the service. Liutong availability, model behavior, latency, pricing, and features may be affected by upstream providers. We are not responsible for third-party services outside our control. ## Security We use reasonable technical and organizational measures designed to protect Liutong. However, no service can be guaranteed secure or uninterrupted. You must not attempt to discover, test, or exploit vulnerabilities except through a program or written authorization approved by LLBY. If you identify a security issue, contact support@llby.org and do not publicly disclose it until we have had a reasonable opportunity to investigate and remediate. ## Service changes and availability We may add, remove, suspend, or modify features, models, endpoints, documentation, limits, or infrastructure at any time. We may perform maintenance or experience outages. We do not guarantee that Liutong will be uninterrupted, error-free, or available in every region or environment. ## Intellectual property LLBY and its licensors retain all rights in Liutong, including software, documentation, APIs, systems, trademarks, and service names. These Terms do not grant you ownership of Liutong or any LLBY intellectual property. Subject to these Terms and applicable law, you retain rights you have in your Input. Rights in Output may be governed by applicable law, your agreement with LLBY, your organization's policies, and upstream provider terms. Feedback you provide may be used by LLBY without restriction or obligation to you. ## Confidentiality Non-public information about Liutong, including API keys, credentials, security details, private documentation, pricing, and operational information, must be treated as confidential unless we make it public or authorize disclosure. ## Termination You may stop using Liutong at any time. We may suspend or terminate access if you violate these Terms, create risk for the service or others, fail to pay applicable fees, or if required by law or provider requirements. After termination, provisions that by their nature should survive will survive, including payment obligations, confidentiality, disclaimers, limitations of liability, and dispute-related provisions. ## Disclaimers Liutong is provided "as is" and "as available." To the maximum extent permitted by law, LLBY disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability. You are solely responsible for determining whether Liutong and any Output are appropriate for your use case. ## Limitation of liability To the maximum extent permitted by law, LLBY will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, security incidents caused by your failure to protect credentials, or costs of substitute services. To the maximum extent permitted by law, LLBY's total liability for all claims relating to Liutong or these Terms will not exceed the amounts paid by you to LLBY for Liutong in the 12 months before the event giving rise to liability, or $100 if no amounts were paid directly to LLBY. ## Indemnity You will defend, indemnify, and hold harmless LLBY and its affiliates, officers, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your use of Liutong, your Input or Output, your violation of these Terms, or your violation of law or third-party rights. ## Changes to these Terms We may update these Terms from time to time. When we do, we will update the "Last updated" date above.
